The agreement between you and BharatGo covering accounts, platform use, payments, fees, content, and termination.
Overview
Welcome to BharatGo. These Terms of Service (“Terms”) are a legally binding agreement between you (“you”, “your”, or “User”) and Megapod Techworks Private Limited, the company that owns and operates the BharatGo brand (“BharatGo”, “we”, “us”, or “our”). They govern your access to and use of BharatGo Ecommerce, BharatGo Smart POS, BharatGo Creator, our websites, applications, dashboards, store tools, payment features, and support services (collectively, the “Services”).
By creating an account, clicking to accept, purchasing a plan, publishing a store, listing a product, or using any Service, you confirm that you have read and agree to these Terms, the Privacy Policy, Acceptable Use Policy, Refund Policy, Prohibited Products Policy, Cookie Policy, and any product-specific terms shown to you. If you do not agree, do not use the Services.
BharatGo provides technology that helps businesses create online stores, manage physical-store billing and inventory, and sell digital products. Unless we expressly say otherwise, BharatGo is not the seller, manufacturer, importer, publisher, fulfilment provider, or contracting party for products and services listed by merchants or creators.
1. Account Terms
- You must be at least 18 years old and legally capable of entering a binding agreement. If you use the Services for a company, partnership, trust, or other organisation, you confirm that you have authority to bind it.
- You must provide complete, accurate, and current information, including identity, business, tax, bank, and contact information where requested. We may verify information and may restrict activity until verification is complete.
- You are responsible for safeguarding passwords, authentication codes, devices, and access to your account. Notify us promptly at contact@bharatgo.com if you suspect unauthorised access.
- You may not create an account for another person without permission, impersonate another person or business, operate multiple accounts to evade a restriction, or transfer an account without our written approval.
- You remain responsible for activity under your account and for ensuring staff, contractors, agencies, and other authorised users follow these Terms.
2. Creator and Seller Responsibilities
You are responsible for your business, products, prices, descriptions, claims, taxes, licences, customer relationships, fulfilment, delivery, refunds, returns, and compliance with all laws that apply to you. This includes consumer protection, taxation, intellectual property, advertising, product safety, data protection, export, and sector-specific requirements.
You must provide buyers with information that is complete, accurate, clear, and not misleading. You must honour orders and digital access that you accept, supply what was advertised, keep inventory and availability current, and respond to customer questions and complaints in a timely manner.
- Only list products, services, files, courses, or content that you own or are authorised to sell or distribute.
- Use reasonable security measures for buyer information and do not use customer information for unrelated marketing or disclosure.
- Maintain records needed for tax, refunds, disputes, product safety, and customer support.
- Publish any additional terms, delivery conditions, cancellation rules, warranties, and refund rules that apply to your offer, provided they do not remove rights that cannot lawfully be excluded.
- For digital products, ensure that files, links, courses, and access credentials are accurate, usable, malware-free, and delivered as promised.
3. Platform Services
Features, limits, integrations, storage, support levels, and availability vary by product, plan, region, account status, and technical conditions. We may improve, modify, limit, or discontinue a feature. We will take reasonable steps to communicate material changes where practical.
Third-party services such as payment processors, banks, delivery providers, analytics tools, messaging providers, app integrations, and hosting providers may have separate terms, fees, eligibility rules, outages, and processing timelines. Your use of those services is also subject to their terms. BharatGo does not guarantee the acts or availability of third parties.
Depending on the service you choose and the customer experience you want to provide, you may use third-party services such as shipping, messaging, payment, analytics, or marketing integrations. Charges for these services are separate from platform and transaction fees, and are deducted from your Wallet (credit balance). You are required to recharge your Wallet in advance through your dashboard or account. Charges are deducted based on the usage and pricing terms of the respective service and the applicable platform or service fees. Wallet recharges (credit purchases) are generally non-refundable, except where required by law or expressly approved by BharatGo.
Some plans may include or offer hardware, devices, or tools such as printers as part of a Smart POS package, or these may be sold separately. Any such hardware or device is provided subject to the applicable manufacturer’s warranty (if any) and the manufacturer’s or third-party supplier’s policies. BharatGo is not the manufacturer and cannot be held liable for hardware defects, performance, availability, or warranty fulfilment. Where possible, BharatGo may help facilitate communication between you and the manufacturer or supplier, but does not guarantee any outcome.
4. Fees and Payments
Applicable subscription fees (which may be fixed monthly or annual amounts) and transaction fees (which may be a fixed amount or a percentage of each successful sale) are shown at checkout, in your account, or on our pricing pages at the time of purchase. Free plans may be available for some products. Pricing, plans, fees, and feature inclusions may change prospectively as described below.
The price, fee, tax, discount, billing period, and feature set shown at checkout or in your account at the time of purchase apply to that purchase. We may change prices, transaction fees, plans, limits, or add-on terms prospectively. Taxes may be added where required.
Subscription fees are charged for the selected billing period. Unless required by law or expressly stated at checkout, fees for a billing period that has started are non-refundable. You authorise BharatGo and its payment partners to charge applicable fees, taxes, adjustments, refunds, reversals, and amounts owed.
Payment processing, settlement, and payouts may be delayed, held, reversed, adjusted, or withheld where reasonably necessary for refunds, chargebacks, suspected fraud, identity verification, payment-network rules, legal compliance, or protection of users and BharatGo. You remain responsible for taxes arising from your sales, income, products, and use of the Services.
Your Wallet (credit balance) is used to pay for third-party services, platform fees, transaction fees, and other applicable charges. You must maintain a sufficient balance to continue using chargeable services. If your Wallet balance is insufficient, affected services may be paused or restricted until you recharge. Wallet recharges are generally non-refundable except where required by law or expressly approved by BharatGo. Unused balances may be subject to expiry or adjustment as communicated in your account or the applicable service terms.
5. Intellectual Property and Content
The Services, software, design, branding, documentation, and BharatGo content are owned by BharatGo or its licensors and are protected by applicable law. These Terms grant you a limited, revocable, non-exclusive, non-transferable right to use the Services; they do not transfer ownership.
You retain ownership of content you submit, including store content, product information, files, logos, images, and customer-provided content. You grant BharatGo a worldwide, non-exclusive, royalty-free licence to host, reproduce, format, transmit, display, adapt, and otherwise use that content as reasonably necessary to provide, secure, improve, support, and promote the Services. You confirm that you have all rights and permissions needed to grant this licence.
You must not copy, resell, reverse engineer, interfere with, scrape, circumvent limits on, or use the Services to build a competing service except where applicable law does not permit that restriction.
6. Buyer Relationships and Complaints
A buyer’s purchase is generally a contract between the buyer and the seller or creator. You are responsible for customer support, fulfilment, delivery, refunds, returns, warranties, representations, and legal compliance relating to your offer. BharatGo may assist with a dispute, but does not guarantee a seller’s performance or act as the buyer’s agent.
You authorise BharatGo to share relevant order, payment, and contact information with the buyer, payment partners, delivery providers, or authorities where needed to complete a transaction, investigate a complaint, process a refund, prevent fraud, or comply with law.
7. Prohibited Conduct
You may not use the Services for fraud, money laundering, sanctions evasion, infringement, harassment, malware, unauthorised access, deceptive marketing, illegal or unsafe products, or activity that threatens buyers, sellers, BharatGo, payment partners, or the public. The Acceptable Use Policy and Prohibited Products Policy form part of these Terms.
- Do not manipulate transactions, reviews, rankings, traffic, analytics, payouts, discounts, or referrals.
- Do not use another person’s identity, payment method, personal information, intellectual property, or account without authorisation.
- Do not send spam, phishing messages, unsolicited commercial communications, or content designed to mislead or harm.
- Do not attempt to bypass identity checks, limits, security controls, payment decisions, suspension, or enforcement.
8. Privacy and Data
The Privacy Policy explains how BharatGo collects, uses, shares, stores, and protects personal information. When you collect personal information through a BharatGo-powered store, you are responsible for providing required notices, obtaining required permissions, responding to data requests, and using the information lawfully.
9. Limitation of Liability
The Services are provided on an “as available” and “as is” basis to the maximum extent permitted by law. We do not guarantee uninterrupted availability, a particular level of sales, search ranking, payment approval, delivery outcome, tax result, or business performance. We are not responsible for the acts or omissions of buyers, sellers, creators, payment providers, delivery providers, or other third parties. To the maximum extent permitted by law, BharatGo is not liable for any hardware, device, or tool (such as a printer) provided as part of a plan or sold separately, including defects, performance, availability, or warranty fulfilment; any such product is governed by the applicable manufacturer’s or supplier’s warranty and policies.
To the maximum extent permitted by law, BharatGo will not be liable for indirect, incidental, special, consequential, exemplary, or punitive loss, or for loss of profits, revenue, goodwill, data, customers, or business opportunity arising from use of or inability to use the Services. BharatGo’s aggregate liability for claims relating to the Services will be limited to the fees paid by you to BharatGo for the affected Services during the three months preceding the event giving rise to the claim, except where applicable law does not permit that limitation.
10. Indemnity
You will defend, indemnify, and hold harmless BharatGo and its affiliates, officers, employees, contractors, and service providers from claims, losses, liabilities, costs, and expenses arising from your content, products, customers, business, breach of these Terms, or violation of law or another person’s rights.
11. Termination and Suspension
We may restrict, suspend, or terminate access where you breach these Terms, create risk, fail to pay, receive excessive complaints or disputes, provide inaccurate information, or where required by law or a service provider. We may suspend activity while investigating an issue. You may stop using the Services at any time, subject to outstanding obligations, refunds, disputes, and legally required retention.
On termination, your permission to use the Services ends. We may remove or restrict store content and access. Provisions concerning payments, content rights, confidentiality, indemnity, limitations of liability, disputes, and obligations that by their nature should survive will continue.
12. Modifications
We may update these Terms to reflect changes to the Services, law, or risk. We will publish the revised version and update the date. Continued use after the effective date means you accept the revised Terms. If a change materially disadvantages you, you may stop using the affected Service before it takes effect, subject to outstanding obligations.
13. Governing Law and Disputes
These Terms are governed by the laws of India, subject to mandatory consumer protections and the jurisdiction of the applicable BharatGo entity. We encourage you to contact us first so that we can try to resolve a dispute informally. Nothing in these Terms prevents a person from using a statutory consumer, regulatory, or other remedy that cannot lawfully be excluded.
